Privacy Policy
Data controller. Brainwave Asset Intelligence Ltd (registered in England and Wales, No. 17135517) is the data controller for personal data processed through this website.
We are committed to protecting your personal data. Any information you provide to us via this website (for example through our contact form, chatbot, or email) will be handled in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations (PECR).
We collect only the information necessary to respond to your enquiry and will never sell your data. We may share limited data with trusted third-party service providers who help us deliver or support this website, as described in our Cookie Notice.
Named data processors. We use the following third-party service providers, all of which act on our behalf:
Website hosting and infrastructure:
- Netlify (United States). Netlify hosts this website, processes contact form submissions, and runs the server-side chatbot function. Netlify may log standard request data including IP addresses as part of normal hosting operations. Netlify's data processing agreement is available at netlify.com/gdpr-ccpa.
Consent management:
- Cookiebot, operated by Usercentrics A/S (Denmark). Cookiebot provides the consent banner and cookie declaration used on this website, scans the site monthly to maintain the cookie list, and stores an anonymised record of each consent event to demonstrate compliance.
Aggregate site analytics (no consent required, cookieless):
- Plausible Analytics, operated by Plausible Insights OÜ (Estonia, EEA), hosted in Germany. Plausible provides privacy-first website analytics. It sets no cookies, stores no personal data, does not track visitors across websites, and does not fingerprint users. Unique-visit counts are derived from a rotating daily hash of IP + user agent that is never stored. For this reason, Plausible is loaded without requiring consent under PECR and UK GDPR. Behavioural analytics (consent required):
- Microsoft Clarity, operated by Microsoft Corporation. Clarity records anonymised session information including clicks, scroll depth, and mouse movements to help us understand how the site is used and identify usability issues. Clarity does not record keystrokes entered into forms or other sensitive input. Data is processed under Microsoft's EU Data Boundary commitment where available. Clarity is loaded only after you consent to Statistics cookies via the Cookiebot dialog. See the Clarity FAQ for data handling details.
Tag management and marketing (consent required):
- Google Tag Manager (Google LLC, United States). We use Google Tag Manager as a container for any analytics or marketing tags deployed on this site. Tag Manager itself does not set tracking cookies, but the tags it deploys may do so. All such tags are blocked until you consent via the Cookiebot dialog. The specific tags and cookies in use at any given time are listed in the Cookie Notice. Google's data processing terms are available at business.safety.google/processorterms.
- Apollo.io (Apollo.io, Inc., United States). Deployed via Google Tag Manager and fired only after you accept the Marketing category through the Cookiebot dialog. Apollo receives your IP address, user agent, referrer, and page view data, and may attempt to match the visit to a business organisation record for B2B visitor intelligence. Apollo's processor terms are available at apollo.io/privacy-policy.
AI processing:
- Anthropic (United States). When you use the chatbot on this website, the text of your messages is sent to Anthropic's API and processed by the Claude AI model to generate a response. Under Anthropic's Commercial Terms, API inputs and outputs are not used to train Anthropic's models. Anthropic may retain API inputs and outputs for up to 30 days for trust, safety, and abuse monitoring, after which they are deleted. See Anthropic's Commercial Terms and Privacy Centre for details.
Netlify, Google, Microsoft, Apollo.io, and Anthropic are based in or operate from the United States; Cookiebot (Usercentrics A/S, Denmark) and Plausible (Plausible Insights OÜ, Estonia, hosted in Germany) operate within the EEA. Any transfer of personal data to the United States relies on the UK International Data Transfer Addendum and Standard Contractual Clauses. No data is shared with tags deployed via Google Tag Manager unless you consent through the Cookiebot dialog; Microsoft Clarity requires Statistics consent, and Apollo.io requires Marketing consent. Netlify, Cookiebot, Plausible, and Anthropic process data as part of core website functionality and the consent or measurement mechanisms.
Lawful bases for processing. We rely on: (a) your consent, managed through Cookiebot, for any non-essential cookies or tracking technologies listed in our Cookie Notice; (b) legitimate interests for responding to enquiries you initiate and for limited business-to-business research carried out in a way that respects your reasonable expectations; and (c) legal obligation where we are required to retain records.
Chatbot. This website includes an AI-powered chatbot. When you use it, the content of your messages is sent to a server-side function hosted by Netlify and then forwarded to Anthropic (United States), where the Claude AI model generates a response. We do not store chatbot conversations on our own systems; the conversation exists only in your browser and is discarded when you close the page. Under Anthropic's Commercial Terms, your inputs are not used to train Anthropic's models, but Anthropic may retain inputs and outputs for up to 30 days for trust, safety, and abuse monitoring. Our lawful basis for this processing is our legitimate interest in providing an information assistant you have actively chosen to use; transfers to the United States rely on the UK International Data Transfer Addendum and Standard Contractual Clauses. Please do not enter confidential, classified, or personal data into the chatbot.
Data retention. Personal data submitted through the contact form or by email is retained for up to 12 months from the date of your last interaction with us, after which it is securely deleted unless we have an ongoing business relationship or a legal obligation to retain it. Cookie consent records are retained by Cookiebot for 12 months from the date of consent, in line with ICO guidance, to demonstrate compliance. Chatbot messages are not retained after your session ends.
Your rights. You have the right to request access to, correction of, or deletion of your personal data; to object to processing; to request restriction of processing; to data portability; and to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal. You can exercise any of these rights, or lodge a complaint, by contacting us at hello@brainwaveassetintelligence.co.uk. You also have the right to complain to the UK Information Commissioner's Office at ico.org.uk.
